1. Scope and Definitions
These Regulations govern the participation of individuals in the Official Affiliate Partner Program of the TEMTUDO platform ("Platform"). The purpose is the promotion and mediation of commercial establishments, professionals, and service providers for subscription plan enrollments.
2. Affiliate Eligibility Requirements
- Must be an individual with full legal capacity and at least 18 (eighteen) years of age on registration date.
- Hold a valid Individual Taxpayer ID (CPF) in good standing with the Federal Revenue of Brazil.
- Timely verify email and mobile phone number via one-time passcode (OTP).
- Register a valid bank account in a financial institution authorized by the Central Bank of Brazil, under the same ownership and CPF registered.
3. Attribution Rule and First Acquisition
Commissions are due exclusively on the first eligible purchase of new businesses that have never subscribed or had previous accounts on the Platform.
- Businesses with previously registered tax IDs (CNPJ), former subscribers, or re-hires are strictly disqualified from earning credit.
- Attribution takes place upon voluntary entry of the affiliate's code by the customer at checkout or via direct referral link.
- There is no retroactive attribution for referrals completed without identifying the partner code.
4. Commission Models and Installments
The percentage and payout schedule strictly adhere to the snapshot of the Active Policy at the time the referred business subscription is created:
- Annual Subscriptions: The commission may be settled as a single lump sum or distributed proportionately across up to 12 (twelve) monthly installments, per the applicable policy version.
- Monthly Subscriptions: The commission is determined on a renewal cycle basis, capped at up to 6 (six) monthly installments, conditioned on the referred company's good standing.
5. Operational Clearance and Absence of Automatic Split
To ensure transactional integrity, chargeback protection, and statutory consumer withdrawal rights (Art. 49 of the Brazilian Consumer Defense Code), each commission installment fulfills a 30 (thirty) consecutive calendar day operational hold from payment confirmation by the payment gateway.
The Platform operates without automatic gateway split mechanisms. Payouts are processed manually by the administration's financial team, via Pix or wire transfer (TED), accompanied by an audited receipt and idempotency key logged in the dashboard.
6. Prohibited Practices and Termination
Any abusive practice is strictly forbidden, including but not limited to:
- Sending unsolicited bulk messages (SPAM) via WhatsApp, email, or social media.
- Falsely representing oneself as an employee, officer, or legal agent of the TEMTUDO brand.
- Promising nonexistent benefits, exemptions, or discounts not expressly authorized by the Platform.
- Conducting fraudulent self-referrals or simulating third-party details without consent.
Violations will trigger immediate suspension or termination of the affiliate account, with consequent cancellation of any pending or withheld installments.
7. Amendments to these Regulations
The Platform reserves the right to update these Regulations at any time by publishing a revised version. Previously completed referrals retain the conditions in force as of their creation date.
